Di Malaysia, profesion ejen hartanah dikawal oleh <strong data-start=\"470\" data-end=\"550\">Akta Penilai, Pentaksir, Ejen Harta Tanah dan Pengurus Harta 1981 (Akta 242)<\/strong> serta peraturan yang ditetapkan oleh <strong data-start=\"588\" data-end=\"663\">Lembaga Penilai, Pentaksir, Ejen Harta Tanah dan Pengurus Harta (LPPEH)<\/strong>.<\/p>\n<hr data-start=\"668\" data-end=\"671\" \/>\n<h2 style=\"text-align: justify;\" data-start=\"673\" data-end=\"737\"><strong data-start=\"676\" data-end=\"735\">1. Hak Eksklusif untuk Menjual atau Menyewakan Hartanah<\/strong><\/h2>\n<p style=\"text-align: justify;\" data-start=\"738\" data-end=\"796\">\ud83d\udd39 <strong data-start=\"741\" data-end=\"770\">Peruntukan Undang-Undang:<\/strong> Seksyen 22C(1) Akta 242<\/p>\n<ul style=\"text-align: justify;\" data-start=\"797\" data-end=\"1007\">\n<li data-start=\"797\" data-end=\"913\">Pemilik hartanah tidak boleh melantik ejen lain atau menjual hartanah sendiri dalam tempoh perjanjian eksklusif.<\/li>\n<li data-start=\"914\" data-end=\"1007\">Semua urusan jualan atau penyewaan mesti melalui ejen yang telah diberikan hak eksklusif.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\" data-start=\"1009\" data-end=\"1124\">\ud83d\udccc <strong data-start=\"1012\" data-end=\"1021\">Nota:<\/strong> Perjanjian eksklusif harus dinyatakan secara bertulis untuk mengelakkan pertikaian di kemudian hari.<\/p>\n<hr data-start=\"1126\" data-end=\"1129\" \/>\n<h2 style=\"text-align: justify;\" data-start=\"1131\" data-end=\"1169\"><strong data-start=\"1134\" data-end=\"1167\">2. Hak untuk Mendapat Komisen<\/strong><\/h2>\n<p style=\"text-align: justify;\" data-start=\"1170\" data-end=\"1299\">\ud83d\udd39 <strong data-start=\"1173\" data-end=\"1202\">Peruntukan Undang-Undang:<\/strong> Peraturan 102 dalam <strong data-start=\"1223\" data-end=\"1297\">Peraturan Penilai, Pentaksir, Ejen Harta Tanah dan Pengurus Harta 1986<\/strong><\/p>\n<ul style=\"text-align: justify;\" data-start=\"1300\" data-end=\"1681\">\n<li data-start=\"1300\" data-end=\"1419\">Jika hartanah berjaya dijual dalam tempoh perjanjian, ejen berhak mendapat komisen penuh seperti yang dipersetujui.<\/li>\n<li data-start=\"1420\" data-end=\"1540\">Jika pemilik menjual sendiri atau melalui ejen lain dalam tempoh eksklusif, ejen asal masih berhak mendapat komisen.<\/li>\n<li data-start=\"1541\" data-end=\"1681\">Kadar komisen yang dibenarkan adalah maksimum <strong data-start=\"1589\" data-end=\"1617\">3% daripada harga jualan<\/strong> (untuk hartanah individu) dan <strong data-start=\"1648\" data-end=\"1678\">10% bagi pasaran komersial<\/strong>.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\" data-start=\"1683\" data-end=\"1800\">\ud83d\udccc <strong data-start=\"1686\" data-end=\"1695\">Nota:<\/strong> Jika pemilik melanggar perjanjian, ejen boleh mengambil tindakan undang-undang untuk menuntut komisen.<\/p>\n<hr data-start=\"1802\" data-end=\"1805\" \/>\n<h2 style=\"text-align: justify;\" data-start=\"1807\" data-end=\"1858\"><strong data-start=\"1810\" data-end=\"1856\">3. Hak untuk Menentukan Strategi Pemasaran<\/strong><\/h2>\n<p style=\"text-align: justify;\" data-start=\"1859\" data-end=\"1967\">\ud83d\udd39 <strong data-start=\"1862\" data-end=\"1891\">Peruntukan Undang-Undang:<\/strong> Tiada peruntukan khusus, tetapi dilindungi di bawah perjanjian eksklusif.<\/p>\n<ul style=\"text-align: justify;\" data-start=\"1968\" data-end=\"2219\">\n<li data-start=\"1968\" data-end=\"2095\">Ejen boleh menjalankan sebarang bentuk pemasaran termasuk iklan digital, media sosial, papan iklan, dan laman web hartanah.<\/li>\n<li data-start=\"2096\" data-end=\"2219\">Pemilik tidak boleh mengiklankan hartanah melalui pihak lain atau mempengaruhi kaedah pemasaran tanpa persetujuan ejen.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\" data-start=\"2221\" data-end=\"2351\">\ud83d\udccc <strong data-start=\"2224\" data-end=\"2233\">Nota:<\/strong> Pemasaran palsu atau mengelirukan boleh dikenakan tindakan di bawah <strong data-start=\"2302\" data-end=\"2348\">Akta Perlindungan Pengguna 1999 (Akta 599)<\/strong>.<\/p>\n<hr data-start=\"2353\" data-end=\"2356\" \/>\n<h2 style=\"text-align: justify;\" data-start=\"2358\" data-end=\"2422\"><strong data-start=\"2361\" data-end=\"2420\">4. Hak untuk Mengawal Rundingan Harga dan Syarat Jualan<\/strong><\/h2>\n<p style=\"text-align: justify;\" data-start=\"2423\" data-end=\"2541\">\ud83d\udd39 <strong data-start=\"2426\" data-end=\"2455\">Peruntukan Undang-Undang:<\/strong> Dilindungi di bawah perjanjian eksklusif yang dipersetujui antara ejen dan pemilik.<\/p>\n<ul style=\"text-align: justify;\" data-start=\"2542\" data-end=\"2684\">\n<li data-start=\"2542\" data-end=\"2612\">Ejen bertindak sebagai perantara rasmi antara pemilik dan pembeli.<\/li>\n<li data-start=\"2613\" data-end=\"2684\">Semua rundingan harga, terma, dan syarat jualan mesti melalui ejen.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\" data-start=\"2686\" data-end=\"2798\">\ud83d\udccc <strong data-start=\"2689\" data-end=\"2698\">Nota:<\/strong> Sebarang campur tangan pemilik tanpa persetujuan ejen boleh dianggap sebagai pelanggaran kontrak.<\/p>\n<hr data-start=\"2800\" data-end=\"2803\" \/>\n<h2 style=\"text-align: justify;\" data-start=\"2805\" data-end=\"2853\"><strong data-start=\"2808\" data-end=\"2851\">5. Hak untuk Mendapat Akses ke Hartanah<\/strong><\/h2>\n<p style=\"text-align: justify;\" data-start=\"2854\" data-end=\"2930\">\ud83d\udd39 <strong data-start=\"2857\" data-end=\"2886\">Peruntukan Undang-Undang:<\/strong> Dilindungi di bawah perjanjian eksklusif.<\/p>\n<ul style=\"text-align: justify;\" data-start=\"2931\" data-end=\"3109\">\n<li data-start=\"2931\" data-end=\"3031\">Ejen berhak mengatur lawatan hartanah (house viewing) dengan pembeli atau penyewa yang berminat.<\/li>\n<li data-start=\"3032\" data-end=\"3109\">Pemilik perlu memberi kerjasama untuk memastikan lawatan berjalan lancar.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\" data-start=\"3111\" data-end=\"3235\">\ud83d\udccc <strong data-start=\"3114\" data-end=\"3123\">Nota:<\/strong> Jika pemilik menghalang ejen daripada menjalankan tugasnya, ia boleh dianggap sebagai pelanggaran perjanjian.<\/p>\n<hr data-start=\"3237\" data-end=\"3240\" \/>\n<h2 style=\"text-align: justify;\" data-start=\"3242\" data-end=\"3310\"><strong data-start=\"3245\" data-end=\"3308\">6. Hak untuk Menjalankan Kajian Pasaran dan Penilaian Harga<\/strong><\/h2>\n<p style=\"text-align: justify;\" data-start=\"3311\" data-end=\"3366\">\ud83d\udd39 <strong data-start=\"3314\" data-end=\"3343\">Peruntukan Undang-Undang:<\/strong> Seksyen 22B Akta 242<\/p>\n<ul style=\"text-align: justify;\" data-start=\"3367\" data-end=\"3622\">\n<li data-start=\"3367\" data-end=\"3472\">Ejen hartanah boleh melakukan analisis pasaran dan memberikan cadangan harga berdasarkan data semasa.<\/li>\n<li data-start=\"3473\" data-end=\"3622\">Ejen boleh merujuk laporan rasmi daripada <strong data-start=\"3517\" data-end=\"3568\">Jabatan Penilaian dan Perkhidmatan Harta (JPPH)<\/strong> atau <strong data-start=\"3574\" data-end=\"3619\">Pusat Maklumat Harta Tanah Negara (NAPIC)<\/strong>.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\" data-start=\"3624\" data-end=\"3728\">\ud83d\udccc <strong data-start=\"3627\" data-end=\"3636\">Nota:<\/strong> Hanya ejen hartanah berdaftar yang boleh menjalankan penilaian harga hartanah secara sah.<\/p>\n<hr data-start=\"3730\" data-end=\"3733\" \/>\n<h2 style=\"text-align: justify;\" data-start=\"3735\" data-end=\"3787\"><strong data-start=\"3738\" data-end=\"3785\">7. Hak Dilindungi oleh Perjanjian Eksklusif<\/strong><\/h2>\n<p style=\"text-align: justify;\" data-start=\"3788\" data-end=\"3840\">\ud83d\udd39 <strong data-start=\"3791\" data-end=\"3820\">Peruntukan Undang-Undang:<\/strong> Akta Kontrak 1950<\/p>\n<ul style=\"text-align: justify;\" data-start=\"3841\" data-end=\"4092\">\n<li data-start=\"3841\" data-end=\"3947\">Ejen dan pemilik perlu menandatangani perjanjian bertulis yang menyatakan semua hak dan tanggungjawab.<\/li>\n<li data-start=\"3948\" data-end=\"4092\">Jika pemilik melanggar perjanjian dengan melantik ejen lain atau menjual tanpa melalui ejen eksklusif, tindakan undang-undang boleh diambil.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\" data-start=\"4094\" data-end=\"4229\">\ud83d\udccc <strong data-start=\"4097\" data-end=\"4106\">Nota:<\/strong> Perjanjian eksklusif harus menyatakan dengan jelas tempoh kontrak, kadar komisen, dan hak ejen sepanjang tempoh kontrak.<\/p>\n<p style=\"text-align: justify;\" data-start=\"4256\" data-end=\"4573\">Perjanjian eksklusif memberi jaminan kepada ejen hartanah bahawa mereka boleh menjalankan kerja dengan lebih fokus dan profesional tanpa persaingan yang tidak adil daripada pemilik atau ejen lain. Pada masa yang sama, pemilik hartanah mendapat perkhidmatan yang lebih teliti dan komited daripada ejen yang dilantik.<\/p>\n<p style=\"text-align: justify;\" data-start=\"4575\" data-end=\"4600\">\ud83d\udccc <strong data-start=\"4578\" data-end=\"4598\">Nasihat Penting:<\/strong><\/p>\n<ul style=\"text-align: justify;\" data-start=\"4601\" data-end=\"4824\">\n<li data-start=\"4601\" data-end=\"4725\">Ejen hartanah harus memastikan bahawa perjanjian eksklusif ditandatangani dengan jelas sebelum mula memasarkan hartanah.<\/li>\n<li data-start=\"4726\" data-end=\"4824\">Pemilik pula perlu memahami bahawa melanggar perjanjian boleh membawa implikasi undang-undang.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Apabila seorang ejen hartanah mendapat hak jualan secara eksklusif daripada pemilik rumah atau tanah, ejen tersebut dilindungi oleh undang-undang dan mempunyai hak-hak tertentu.
